Your usage of the services we offer (the "Hosting Services") is governed by our acceptable use policy. By using the Hosting Services, you acknowledge that this acceptable usage policy supplements our terms and conditions and that you will follow by all of its rules. This Acceptable Use Policy is subject to change by Nosswire AB without prior notification.
You must not allow a third party to access or use the Hosting Services. A breach of this acceptable use policy by a Third Party will be deemed to be a breach of this acceptable use policy by you.
A. Resource usage
- 1. The shared hosting services include giving you access to web space on our servers so you may upload files and pages to create and publish websites.
- 2. You can use the "unmetered" server bandwidth provided by the shared hosting services for typical "non-file-distribution" web activity. We retain the right to impose a monthly bandwidth limit of two hundred and fifty (250) gigabytes for websites that permit the downloading of audio, video, or other materials.
- 3. Any bandwidth limit placed will not impact non-file distribution usage.
- 4. When utilizing the shared hosting services, you will not be able to:
- a. Utilize over 10% of the processing power on our platform. Numerous actions, such as (but not limited to) CGI scripts and extensive FTP, PHP, or HTTP operations, could result in these issues.
- b. execute any daemons or stand-alone, unattended server-side programs, such as (but not limited to) IRCd
- c. launch any kind of indexer or web spider
- d. Launch any application that communicates with a network of Internet relay chats.
- e. launch any client, tracker, or bit torrent program. Legal torrent files may be linked to off-site, but you are not allowed to host or keep them on our servers.
- f. Take part in any peer-to-peer or file-sharing activity
- g. run any gaming servers
- h. execute entries or carry out other prearranged duties without utilizing our management panel for configuration
- i. give away web space under a domain
- j. run a service or website proxy
- k. as an external website's remote file host
- Manage your own self-hosted file sync or comparable cloud storage services, such as OwnCloud, Pydio, and Sparkleshare.
- 5. You are not permitted to utilize the hosting services as a location for offsite backups. Consequently, unless they are required to run the website of which they are a part, all files uploaded to our servers as part of your use of the Hosting Services must be visible and accessible to the outside world (web-visible). We reserve the right to delete files or directories that are not web-visible without providing you with prior notice.
- 6. Unless you take steps to prevent it, search engines will be able to access every page of your website that is stored on our servers as part of the hosting services. You commit to using coding and optimization strategies that completely adhere to the rules set forth by Google, Bing, Yahoo, and other major search engines if you want to make your webpages more search engine friendly.
- 7. MySQL databases have a 1024 megabyte size restriction; we will let you know when your database exceeds this limit.
B. Prohibited uses
- 1. You may use the Hosting Services only for lawful purposes. You may not use the Hosting Services:
- a. in any manner that violates any local, state, federal, or international law or rule that may be in force.
- b. in any manner that is fraudulent or unlawful, or that serves a fraudulent or unlawful aim or effect.
- c. with the intent to damage or seek to damage minors in any manner
- d. sending, intentionally receiving, uploading, downloading, using, or reusing any content that doesn't adhere to our content guidelines (see below)
- e. to send, or arrange for the transmission of, any unsolicited or unauthorized promotional materials, advertisements, or other similar solicitations (also known as SPAM - see below)
- to intentionally distribute, publish, or transmit any files that contain malware, trojan horses, worms, time bombs, keystroke loggers, spyware, adware, or other malicious software that has the potential to negatively impact the functionality of any computer hardware or software
C. Content standards
- 1. All content that you permit to be hosted via the Hosting Services, as well as any related interactive services, are subject to these content guidelines.
- 2. You have to abide by the following norms in spirit. Both the entire Material and any of its components are subject to the standards.
- 3. Content needs to:
- a. Be truthful (when stating facts)
- b. be sincere in their beliefs (when they express opinions)
- c. adhere to all applicable laws in thenation where they are placed.
- 4. Content shouldn't:
- A. include any content that disparages any individual
- b. include any offensive, provocative, hateful, or vulgar content.
- c. include any pornographic content.
- d. encourage acts of violence
- e. encourage prejudice against people on the basis of their age, sexual orientation, handicap, nationality, race, sex, or religion
- f. violate someone else's trade mark, copyright, or database rights
- g. have the ability to trick anyone
- h. be made in violation of any legal obligation due to a third party, including a duty of confidence or a contractual obligation
- i. Encourage any illegal conduct
- j. pose a threat, violate or mistreat the private of another, or inflict irritation, inconvenience, or undue worry
- be utilized to pretend to be someone else, conceal your identify, or imply that you are associated with someone else
- m. give the impression that they emanate from us, if this is not the case
- n. support, encourage, or aid in any illegal activity, including (but not limited to) copyright violations or improper use of computers.
D. Zero Tolerance Spam Policy
- 1. We have a zero-tolerance policy for spam, unwanted emails, and mass emails. Any user whose account sends out spam may have it terminated, with or without notice.
- 2. We willnot host websites that are promoted as spam on our servers. Spam transmitted by fax, phone, postal mail, email, instant messaging, or newsgroups is covered by this clause, among other things. Any user account that leads to a blacklisting of our IP space will be promptly suspended or deleted.
- 3. Nosswire AB retains the right to demand modifications or, if required, to disable any website, account, database, or component that violates our policies.
- 4. At our sole discretion, Nosswire AB retains the right to charge the owner of the account used to send any unsolicited emails a clean-up fee or other costs associated with having the account removed from the blacklist.
E. Reselling
- You consent to refrain from:
- a. Resell or make any portion of our hosting services available to other parties for use.
- b. not to enter without permission, tamper with, harm, or disturb:
- i. Any area where Hosting Services are provided
- ii. any device or network that is utilized to deliver the hosting services
- iii. any program utilized to deliver the hosting services
- iv. any hardware, software, or network that is possessed or utilized by a third party
F. Suspension and termination
- 1. We reserve the right to decide whether your usage of the Hosting Services constitutes a violation of this acceptable use policy. In the event that this policy has been broken, we reserve the right to take whatever appropriate action.
- a. The right to use the Hosting Services may be withdrawn immediately, temporarily, or permanently.
- b. the removal of any Materials uploaded to our servers, whether instantaneous, temporary, or permanent.
- c. sending you a warning
- d. launching legal action against you to recover all expenses incurred as a result of the violation, including reasonable administrative and legal expenses, on an indemnity basis.
- e. further lawsuits brought against you
- f. providing law enforcement officials with the information we deem reasonably necessary
G. Changes to our acceptable use policy
